Relationship between Songwriter and Publisher

 

The songwriter is a composer of music and/or an author of lyrics of musical compositions and/or an arranger of music in the public domain. The publisher is a corporation which is engaged in the business of publishing, selling and exploiting songs, music and other like literary, dramatic and artistic property. The publisher agrees to pay the songwriter during the contract term a specified amount of money on a regular basis as a nonreturnable advance and to be deducted from any and all royalties accruing to the songwriter. The songwriter agrees to sell, assign and transfer to the publisher all rights of all musical compositions including title, words and music that the songwriter has invented, written, conceived, arranged, composed, created or originated during the contract term. The publisher agrees to pay to the songwriter or, upon his/her death, to the persons legally entitled to, during the period of copyright protection of the compositions. The royalties will be paid in instances where the songwriter was the sole author and composer of the musical composition and, with regard to compositions where the songwriter has a collaborator, the songwriter will be paid only such portion of the royalties were shared equally among all writers of such composition. The songwriter agrees that all of the lyrics and music delivered by the songwriter to the publisher will be the songwriter's own original composition or arrangements and that no part will be an imitation or copy of any other copyright work.
